BOS sets hearing to consider abandonment of county road

CAME ON FOR CONSIDERATION before the Perry County, Mississippi Board of Supervisors the matter of setting a public hearing to consider abandoning a section of the County road system. After discussion of the matter, the following Order was offered by Supervisor Marc Williams, and seconded by Supervisor Kevin Shows to-wit:

ORDER SETTING HEARING

WHEREAS, the Perry County, Mississippi Board of Supervisors (the “County”) has authority under Section 65-7-121 of the Mississippi Code of 1972 (the “Statute”) to consider, upon its own motion or upon a petition, the abandonment of a section of the County road system; and,

WHEREAS, the County has determined it should consider altering or abandoning the following road:
The Bill Herring Road for its entire length. Said Road is Supervisor Districts 1 and 5

WHEREAS, the Statute calls for a public hearing prior to the consideration of the matter, with notice of the hearing to be published two (2) times, not less than two (2) weeks prior to the date of the hearing; and,

WHEREAS, in compliance with the Statute, the hearing should be held at 10:00 am in the board room at the Supervisor’s Annex to the Perry County Courthouse on March 2, 2020, and the notice of such hearing should be published on February 13 and 20, 2020 in The Richton Dispatch, with proof of publication to be included in the minutes of the hearing; and,

WHEREAS, the County, after hearing from the public on the matter and making appropriate findings on the record, will make a determination as to whether or not the road described herein should be abandoned or altered and any easement(s) or right of way obtained for the purpose of opening that portion only of the road is to be abrogated and returned to the adjoining property owner(s).

IT IS, THEREFORE, ORDERED by the Board of Supervisors of Perry County, Mississippi, as follows:
1. The County hereby determines that it should consider abandoning all or a portion of the Bill Herring Road in Supervisor Districts 1 and 5 as described herein.
2. The date of a hearing to consider this matter shall be set for 10:00 am on March 2, 2020 at the Supervisor’s Annex to the Perry County Courthouse in New Augusta, Mississippi.
3.In compliance with the Statute, a notice of the hearing shall be published in The Richton Dispatch on February 13 and 20, 2020 and the proof of publication is to the entered into the minutes.

The Order was then adopted with the following Supervisors voting aye/nay:
District 1, Bobby Bolton aye
District 2, Kevin Shows aye
District 3, Tim Wise aye
District 4, Richard Lott aye
District 5, Marc Williams aye

So Ordered, this 3rd day of February, 2020.
