NOTICE OF TRUSTEE’S SALE

WHEREAS, on July 14, 2016, Regina Thomas and Randy Thomas, executed a Deed of Trust, dated July 14, 2016, in favor of Lillous Ann Shoemaker, trustee, for Magnolia State Bank, a banking corporation existing pursuant to the laws of the state of Mississippi, the Secured Party, which Deed of Trust, was recorded July 20, 2016, in Deed of Trust Book 261, at Pages 58-68, of the land records of the Chancery Clerk’s Office, at the Courthouse in and for Perry County, Mississippi, at New Augusta, Mississippi; and
WHEREAS, on September 14, 2017, Regina Thomas and Randy Thomas, executed a Modification of Deed of Trust, dated September 6, 2017, in favor of Lillous Ann Shoemaker, trustee, for Magnolia State Bank, a banking corporation existing pursuant to the laws of the state of Mississippi, the Secured Party, which Modification of Deed of Trust was recorded September 25, 2017, in Deed of Trust Book 268, at Pages 654-659, of the land records of the Chancery Clerk’s Office, at the Courthouse in and for Perry County, Mississippi, at New Augusta, Mississippi; and
WHEREAS, on August 16, 2018, Regina Thomas and Randy Thomas, executed a Deed of Trust, dated August 16, 2018, in favor of Lillous Ann Shoemaker, trustee, for Magnolia State Bank, a banking corporation existing pursuant to the laws of the state of Mississippi, the Secured Party, which Deed of Trust was recorded September 7, 2018, in Deed of Trust Book 273, at Pages 88-98, of the land records of the Chancery Clerk’s Office, at the Courthouse in and for Perry County, Mississippi, at New Augusta, Mississippi; and
WHEREAS, default having been made in the payment of the indebtedness, the payment of which is secured by said deed of trust and modification, said instruments containing the power of sale, and the said beneficiary having requested the undersigned so to do.
NOW, THEREFORE, notice is hereby given that on February 28, 2020, between the hours of 11:00 a.m. and 4:00 p.m. at the East front door of the Perry County Courthouse, in New Augusta, Mississippi, I, the undersigned trustee, will sell at public auction to the highest and best bidder for cash the following described real property located and situated in Perry County, Mississippi:
Commence at a 1½ inch iron well point at the northwest corner of Section 7, Township 3 North, Range 11 West, Perry County, Mississippi, and run East for 3242.51 feet; thence run South for 3000.41 feet to a ½ inch rebar and the Point of Beginning. From the Point Beginning run North 37 degrees 55 minutes 32 seconds East for 300.00 feet to a ½ inch rebar and the south right-of-way line of Old River paved public road; thence run South 52 degrees 04 minutes 28 seconds East along said south right-of-way line for 296.26 feet to a ½ inch rebar; thence run South 55 degrees 42 minutes 47 seconds East along said south right-of-way line for 66.40 feet to a ½ inch rebar; thence run South 37 degrees 55 minutes 32 seconds West for 304.21 feet to a ½ inch rebar; thence run North 52 degrees 04 minutes 28 seconds West for 362.53 feet back to the Point of Beginning, said parcel of land is part of the Northwest ¼ of the Southeast ¼ of Section 7, Township 3 North, Range 11 West, Perry County, Mississippi, and contains 2.50 acres, more or less.
The property is located at 9085 Old River Road, Richton, MS 39476.
The sale will be made without covenant of warranty regarding title, possession, or encumbrances, for the purpose of paying the obligations secured by said deed of trust and modification, including fees, charges, and expenses of the trustee, sums, if any, extended during the term of said deed of trust and modification, interest thereon and all unpaid principal. I will convey only such title as is vested in me as trustee.
The sale is subject to any statutory right of redemption of any governmental agency, state or federal.

WHEREAS, on the 4th day of April, A.D., 1996, STELLA GARNER AND KENNETH GARNER, executed a certain Deed of Trust unto WAYNE DAVIS, Trustee, COMMUNITY BANK, ELLISVILLE, MISSISSIPPI, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Perry County, Mississippi in Deed of Trust Book 132 at Page 913; and
WHEREAS, on the 22nd day of February, A.D., 2012, a Modification of Deed of Trust was executed by the parties, which instrument is recorded in the office of the Chancery Clerk of Perry County, Mississippi in Deed of Trust Book 232 at Page 675; and
WHEREAS, on the 14th day of April, A.D., 2016, a Modification of Deed of Trust was executed by the parties, which instrument is recorded in the office of the Chancery Clerk of Perry County, Mississippi in Deed of Trust Book 259 at Page 674; and
WHEREAS, on the 15th day of January, A.D., 2020, the Beneficiary appointed J. WARD CONVILLE as Substituted Trustee, which instrument is recorded in the office of the Chancery Clerk of Perry County, Mississippi in Substitution of Trustee Book 3 at Page 267; and
WHEREAS, default having been made in the payment of a portion of the indebtedness secured by said Deed of Trust, and the holder of said Deed of Trust having declared all of the amount due and having requested this sale for the purpose of paying said indebtedness or as much thereof as said sale brings; and
NOW THEREFORE, I, J. WHEREAS, on March 20, 2008, Hildred Bolton, a single man, executed a deed of trust to M McIntosh Forsyth, Trustee for the benefit of First National Bank of America, which deed of trust is recorded in Deed of Trust Book 211 at Page 40 and modified in Book 243 at Page 210 in the Office of the Chancery Clerk of the County of Perry, State of Mississippi; and
WHEREAS, the aforesaid deed of trust was assigned to Rose Acceptance, Inc. by instrument dated July 12, 2017, and recorded in the Office of the aforesaid Chancery Clerk in Book 268 at Page 103; and
WHEREAS, the aforesaid, Rose Acceptance, Inc., the holder of said deed of trust and the note secured thereby, substituted Underwood Law Firm PLLC, as Trustee therein, as authorized by the terms thereof, by instrument dated July 12, 2017 and recorded in the Office of the aforesaid Chancery Clerk in Book ST-3 at Page 93; and
